Workers’ Compensation FAQ for Injured New Yorkers
Quick answers to the questions we hear every day. Want to talk it through? Call (212) 487-8669 for a free consultation.
How long do I have to file a workers' compensation claim in New York?
You have two years to file with the Workers' Compensation Board after the accident, or after you discover a work-related illness. You should also notify your employer of the injury within 30 days. Missing a deadline can cost you benefits, so do not wait.
What does it cost to hire a workers' compensation lawyer?
You do not pay legal fees up front. Attorney fees in New York follow a schedule set by state law and must be approved by the Workers' Compensation Board. At Harris Firm, LLC we work on a contingency basis: you pay us only if you receive compensation. Your first consultation is free.
What if the workplace injury was my fault?
New York workers' compensation is a no-fault system. Benefits are paid regardless of who caused the injury, so a mistake at work does not take away your right to file a claim.
Can my employer deny my claim?
Your employer cannot simply refuse your claim. They must send your accident report to their workers' compensation insurer, which approves the claim, denies it, or asks for more information. If your claim is denied or delayed, you can appeal, and we can guide you through it.
What should I do right after getting hurt at work?
Get medical attention first (call 911 for serious injuries). Report the injury to your employer as soon as possible and complete an official accident report. Keep copies of every report and message, follow your doctor's instructions, and send your medical records to your employer and to the Workers' Compensation Board.
